ATSR-002: Registration and regulation of Racing Queensland training contracts (PDF, 67 KB)
What is it?
Racing Queensland (Racing QLD) has certain authorities in the registration and regulation of training contracts for apprentices and trainees in related racing industry apprenticeships and traineeships.
The Training and Employment Recognition Council (TERC), under the jurisdiction of the Vocational Education, Training and Employment Act 2000 (the Act), has delegated this authority to Racing Qld as confirmed in Delegation 21 of the Training and Employment Delegations.
Racing Queensland's responsibilities
As a delegated authority, Racing Qld is responsible for complying with the legislative requirements of the Act. Wherever Racing Qld exercises its delegated authority, it must satisfy the provisions of the Act including the requirements for signed notices, information notices and the application of fair procedures.
Racing Qld must also maintain evidence of the forms used and the processes followed when making decisions and exercising delegations under the Act.
In providing information to the Department of Education and Training (DET), Racing Qld must ensure that any personal information provided has been collected and is being disclosed in line with the Information Privacy Principles set out in the Information Privacy Act 2009.
Metro East district office's role
The Metro East (Lutwyche) district office is DET's office responsible for the entry of all Racing Qld apprenticeship and traineeship transactions into DET's database (DELTA).
Racing Qld's advice to the Metro East district office must contain all relevant particulars of the training contract and details of the transaction (e.g. cancellation - the date of effect and any other information needed for data records such as reason for cancellation, etc). A standard 'Format of Advice' form developed by and stored with Racing Qld exists.
Registration of Racing Queensland training contracts
All racing industry apprenticeships and traineeships associated with Racing Qld have been identified in the Queensland Training Information Service (QTIS). It is noted on QTIS that all racing industry specific training contracts must be forwarded to Racing Qld for approval. This note will help to ensure staff of Australian Apprenticeships Centres direct appropriate training contracts to Racing Qld.
The following process applies to registration of these contracts:

Upon receipt of the completed and signed training contract, the Australian Apprenticeships Centre (AAC) will enter the details into the TYIMS database for electronic transfer to DELTA. Hard copy of the training contract is forwarded to Racing Qld.

The AAC will notify Racing Qld that it has been selected as the supervising registered training organisation (training organisation) for the contract. Racing QLD will accept this notification agreeing that it will take on the responsibilities of a training organisation.

Racing Qld will exercise its delegation to register or to refuse to register the training contract. Racing Qld will notify Metro East district office, using the 'Format of Advice' form, of details of the approved/not approved training contract.

Metro East district office will resubmit the training contract in DELTA, which will create a registration number for the apprenticeship or traineeship. DET will not send any correspondence to parties of the training contract confirming the registration or refusal.

Metro East district office will notify Racing Qld of the registration number and nominal completion date, via return of the 'Format of Advice' form. The AAC will automatically receive notification of the registration number or refusal via TYIMS.

Correspondence related to the registration of the apprenticeship or traineeship will be forwarded by Racing Qld to the parties of the training contract.
Racing Qld holds all documentation relating to the training contract.
Amendment of Racing Queensland training contracts
The following amendments to Racing Qld training contracts are identical to the processes used by all other apprentices, trainees and their employers:
Racing Qld must ensure these amendments contain all signatures required.
Completion of Racing Queensland training contracts
Completions of Racing Qld contracts are also identical to the mainstream process, with the exception of steps 5 and 6.
The training organisation will forward the completion agreement to Racing Qld rather then the district office. Racing Qld will inform Metro East district office of completion details for input into DELTA (using the 'Format of Advice' form). Racing Qld will also issue the completion certificate and inform the employer that the certificate has been issued.

Cancellation of Racing Queensland training contracts
Current Racing Qld procedures require written and signed applications for cancellation which a committee will consider. These procedures satisfy the legislative requirements of the Act, including the need for 'fair procedures'.
Suspension and temporary assignment of Racing Queensland training contracts
If a potential suspension or a necessity to temporarily assign a training contract occurs, Racing Qld should contact Metro East district office on 1800 210 210 for guidance.
